This Privacy Policy explains, clearly and transparently, how CLK Health Tech Private Limited (“24:MORE”, “we”, “us” or “our”) collects, uses, shares, protects and otherwise Processes your Personal Data when you visit, browse or make a purchase through our website (the “Website”). It is published in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the rules made thereunder, and other applicable laws. Please read it together with our Terms and Conditions and our Returns, Refund and Cancellation Policy, each available on the Website.

1. Definitions

In this Privacy Policy, unless the context requires otherwise, the following terms shall have the meanings set out below, and other capitalised terms shall bear the meanings given to them where they first appear:

          “Child” means an individual who has not completed eighteen (18) years of age.

          “Data Fiduciary” means the person who determines the purpose and means of Processing of Personal Data, being us; and “Data Principal” means the individual to whom the Personal Data relates, being you, and includes, in the case of a Child, the parent or lawful guardian, and in the case of a person with a disability, her lawful guardian.

          “Personal Data” means any data about an individual who is identifiable by or in relation to such data, and references to “personal information” shall be construed accordingly.

          “Process” or “Processing” means any operation performed on Personal Data, including its collection, recording, storage, use, sharing, disclosure, retention, erasure or destruction.

          “Service Providers” means the third parties engaged by us to Process Personal Data on our behalf, under our instructions and appropriate safeguards, including our payment gateway, logistics and technology partners.

2. Consent and Your Relationship with Us

In respect of your Personal Data, we are the Data Fiduciary and you are the Data Principal, as defined under the DPDP Act. By providing your details on the Website, placing an order, or otherwise choosing to share your information with us, you consent to our Processing of your Personal Data for the purposes described in this Privacy Policy. Your consent is free, specific, informed and unambiguous, and is given through a clear affirmative action. Where we seek your consent, we will, at or before the time of collection, make available to you a notice describing the Personal Data sought, the purpose for which it is Processed, and the manner in which you may withdraw your consent, exercise your rights, and make a complaint to the Data Protection Board of India. You may withdraw your consent at any time, with the same ease with which it was given, by writing to us at the contact details set out in Clause 10 below, and such withdrawal shall not affect the lawfulness of any Processing carried out before it. Should you prefer not to share your Personal Data with us, we would of course respect that, though we may in that event be unable to accept or fulfil an order.

3. Personal Data We Collect

We believe in collecting only what we genuinely need in order to serve you well. Depending on how you use the Website, we may collect and Process the following:

          Contact and identity information, such as your name, mobile number and email address.

          Order and delivery information, such as your shipping and billing address, the products you order, your order history, and your delivery preferences and instructions.

          Transaction information, such as the fact, date, value and status of your transactions, and confirmations received from our payment gateway partner. Please note that your card, bank account, UPI and other payment credentials are collected and processed directly by our payment gateway partner on its own secure infrastructure, and are not collected or stored by us.

          Information made available through our checkout experience: where you log in using your mobile number, certain details such as your saved name, address and payment preferences may be securely made available to us by our payment gateway partner or its network in order to enable a faster checkout, in accordance with that partner’s terms and privacy policy and subject to your authorisation.

          Technical and usage information, such as your device and browser type, operating system, Internet Protocol (IP) address, and information collected through cookies and similar technologies, as described in Clause 9 below.

          Communications and preferences, such as your correspondence with us, your reviews and feedback, and your marketing preferences.

We do not collect any health information, and the Website does not offer any diagnostic, analytical or assessment tool. Please share with us only the information requested, and kindly refrain from sending us any sensitive information that we have not asked for.

4. How We Use Your Personal Data

We Process your Personal Data to enable you to browse the Website and to create and manage your login; to accept, process, fulfil and deliver your orders and to keep you informed of their status; to process payments through our payment gateway partner and to address any payment related issue; to administer returns, refunds, exchanges and cancellations in accordance with our Returns, Refund and Cancellation Policy; and to respond to your enquiries, requests and grievances. We also use it to operate, personalise, improve and secure the Website and our product offering; to send you, where you have chosen to receive them, updates, offers and communications about our products; to comply with applicable law and to respond to lawful requests from authorities; and to detect, prevent and address fraud, misuse or unauthorised activity. We Process your Personal Data only for these purposes, or for a purpose reasonably connected to and consistent with them, and we collect only such Personal Data as is necessary.

5. Children and Persons with Disability

The Website is intended for use by persons who are eighteen (18) years of age or older, and we do not knowingly collect the Personal Data of a Child. Where an order is to be placed in respect of, or on behalf of, a Child, it must be placed and managed by the Child’s parent or lawful guardian, who accepts this Privacy Policy on the Child’s behalf. We Process a Child’s Personal Data only after obtaining the verifiable consent of the parent or lawful guardian, obtained by email addressed to the contact set out in Clause 10 below, and we may take reasonable steps to confirm that the person providing such consent is an identifiable adult who is the parent or lawful guardian. We do not undertake tracking, behavioural monitoring or targeted advertising directed at children. Where the Data Principal is a person with a disability who has a lawful guardian, we Process her Personal Data only with the consent of such lawful guardian.

6. Sharing of Personal Data

We do not sell your Personal Data, and we do not share it with third parties for their own independent purposes. If and to the extent necessary to operate the Website and to fulfil your order, we share your Personal Data with our Service Providers — principally our payment gateway partner in order to process your payment, our third party logistics partners in order to deliver your order to you, and our technology, hosting, communication and analytics providers — each of whom acts on our behalf, for the limited purpose for which the data is shared, and under contracts requiring appropriate confidentiality and security safeguards. We may also disclose your Personal Data where required under applicable law or by any judicial, regulatory or governmental authority, or where reasonably necessary to establish, exercise or defend legal claims, to prevent fraud or harm, or to protect our rights or those of others; and, in the event of any merger, acquisition, reorganisation or transfer of business, to the successor entity, subject to protections at least as protective as those set out in this Privacy Policy.

7. Storage, Retention and Security

We store your Personal Data on servers located in India, and may Process it outside India only to the extent permitted under the DPDP Act and subject to any conditions or restrictions notified by the Central Government. We retain your Personal Data only for so long as is necessary to serve the purpose for which it was collected, including to fulfil and support your orders, or for such longer period as may be required to comply with applicable law, including our tax, accounting and record keeping obligations and the establishment, exercise or defence of legal claims, following which we shall erase it and require our Service Providers to do the same. We implement reasonable security safeguards designed to protect your Personal Data against unauthorised access, disclosure, alteration or loss, and we require our Service Providers to maintain equivalent safeguards. While we take these matters seriously, you will appreciate that no method of transmission or storage can be guaranteed to be entirely secure, and we would encourage you to exercise appropriate care in protecting your login and account details. In the event of a personal data breach, we shall intimate the affected Data Principals and the Data Protection Board of India in the manner and within the timelines prescribed under the DPDP Act and the rules made thereunder.

8. Your Rights and Responsibilities

Subject to and in accordance with the DPDP Act, you have the right to obtain a summary of the Personal Data we Process about you and the Processing activities undertaken; to seek its correction, completion, updating or erasure; to readily available grievance redressal; to nominate another individual to exercise your rights in the event of your death or incapacity; and to withdraw your consent at any time. To exercise any of these rights, please write to us at the contact details set out in Clause 10 below. We may request such information as is reasonably necessary to verify your identity before acting upon a request, and we shall respond within the timelines prescribed under applicable law. In exercising your rights, you agree to furnish information that is accurate and authentic, not to impersonate any other person, and not to raise any false or frivolous request or complaint.

9. Cookies and Analytics

We use cookies and similar technologies to operate the Website, to keep you signed in, to remember the contents of your cart and your preferences, to understand how the Website is used, and to improve your experience. Some of these are necessary for the Website to function, while others help us measure and enhance performance. You may manage or disable cookies through your browser settings, though certain features of the Website may not function as intended if you do so. We do not use your Personal Data to serve you targeted advertising, and we do not direct any advertising at children.

11. Changes, Governing Law and Severability

We may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law, and the current version will always be available on the Website; where any change materially affects the Processing of your Personal Data or requires your consent, we shall provide you appropriate notice and, where required, seek your fresh consent. This Privacy Policy is governed by and shall be construed in accordance with the laws of India, and any dispute arising out of or in connection with it shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana, without prejudice to any statutory right or remedy available to you under the DPDP Act, the Consumer Protection Act, 2019 or other applicable law, including your right to make a complaint to the Data Protection Board of India. If any provision of this Privacy Policy is held to be invalid or unenforceable, that provision shall be ineffective only to the extent of such invalidity or unenforceability, and the remaining provisions shall continue in full force and effect.
