TERMS AND CONDITIONS
Welcome to 24:MORE. We are delighted to have you here, and we hope you enjoy discovering our products. These Terms and Conditions (the “Terms”) set out the basis on which you may access and use our website and purchase our products (the “Website”), which is owned and operated by CLK Health Tech Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 7th Floor, Landmark House, Plot No. 65, Sector 44, Institutional Area, Gurugram, Haryana, 122003, India (“24:MORE”, “we”, “us” or “our”). We have set them out as clearly as we can, and we invite you to read them. By accessing, browsing or purchasing through the Website, you agree to be bound by these Terms; and if you do not agree with any part of them, we would kindly ask that you not use the Website.
1. Definitions
In these Terms, unless the context requires otherwise, the following terms shall have the meanings set out below:
• “Content” means all text, graphics, logos, images, designs, layouts, product descriptions, photographs, audio, video, software and other material made available on the Website, together with the ‘24:MORE’ name, logos and marks.
• “Products” means the cosmetic and personal care products offered for sale by us through the Website.
• “Order” means a request placed by you through the Website for the purchase of one or more Products.
• “You” or “your” means the person accessing or using the Website or placing an Order.
2. Eligibility and Your Account
You must be eighteen (18) years of age or older and competent to contract under the Indian Contract Act, 1872 in order to purchase through the Website, and by placing an Order you confirm that this is so. The Website does not require you to create a formal account; you may simply sign in using your mobile number, and certain of your details may be securely made available at checkout in order to make your experience quicker and easier. You agree to provide information that is accurate, current and complete, to keep it updated, and to take reasonable care to keep your login credentials, including any one time password, confidential. You will appreciate that we are entitled to treat any Order placed through your verified mobile number as having been placed by you, and we would ask you to notify us promptly if you become aware of any unauthorised use.
3. Products, Descriptions and Claims
We take considerable care in describing and presenting our Products. Product images are for illustration, and while we endeavour to display colours, textures and packaging accurately, minor variations may occur owing to photography, screen settings or periodic updates to packaging and formulation. Our Products are cosmetic products intended for external use, and the claims made in relation to them relate to the appearance and cosmetic condition of the skin and hair. Nothing on the Website constitutes medical advice, diagnosis or treatment, or a claim to prevent, treat or cure any disease or condition, and our Products are not a substitute for professional advice from a qualified healthcare practitioner. We would encourage you to read the label, ingredient list and directions for use carefully before use, to observe any cautions stated, and to discontinue use and seek professional advice should any irritation or adverse reaction occur. If you have sensitive skin, a known allergy, or a pre-existing skin condition, or if you are pregnant or nursing, we would recommend that you consult a qualified healthcare practitioner before use, and, as a general matter, that you carry out a patch test before applying any new product.
4. Orders, Pricing and Payment
The display of Products on the Website is an invitation to offer, and not an offer capable of acceptance. When you place an Order, you make an offer to purchase, and a binding contract arises only when we confirm acceptance of your Order or dispatch the Products, whichever is earlier. We reserve the right, acting reasonably, to decline or cancel an Order in whole or in part, including where the Product is unavailable, where there is an evident error in pricing or description, where we are unable to verify the delivery address or payment, or where we suspect fraud or a breach of these Terms; and in any such case, where payment has already been received, we shall refund the amount in accordance with our Returns, Refund and Cancellation Policy.
Prices are stated in Indian Rupees and are inclusive of applicable taxes unless stated otherwise, and delivery charges, where applicable, are shown before you confirm your Order. Prices, offers and promotions are subject to change, though such changes will not affect an Order we have already accepted. Payment is processed through a third party payment gateway partner, and your payment details are collected and handled directly by that partner on its own secure infrastructure and are not stored by us. Your use of the payment gateway is additionally subject to the terms and privacy policy of the relevant partner, and while we take care in selecting our partners, we are not responsible for the acts or omissions of any payment gateway, bank or payment network.
5. Delivery
We arrange delivery of Products through reputed third party logistics partners. Delivery timelines indicated on the Website are estimates made in good faith and are not guaranteed, and may be affected by matters beyond our reasonable control, including the accuracy of the address provided, the availability of a recipient, weather, transport disruptions, and restrictions imposed by any authority. Risk in the Products shall pass to you upon delivery to you or to any person at the delivery address who accepts delivery on your behalf. We would ask you to inspect your parcel upon delivery and to notify us promptly, and in any event within the period specified in our Returns, Refund and Cancellation Policy, of any damage, shortage or discrepancy, so that we may put matters right.
6. Returns, Refunds and Cancellations
Our arrangements in relation to returns, refunds, exchanges and cancellations are set out in our Returns, Refund and Cancellation Policy, available on the Website, which forms part of these Terms and should be read together with them. We would encourage you to review it before placing an Order.
7. Acceptable Use
We ask that you use the Website only for lawful purposes and in accordance with these Terms. In particular, you agree not to use the Website in any manner that could disable, overburden, damage or impair it or interfere with any other person’s use of it; not to use any robot, spider, scraper or other automated means to access it without our prior written permission; not to introduce any virus, malware or other harmful code; not to attempt to gain unauthorised access to any part of the Website or its underlying systems or data; not to impersonate any person or misrepresent your identity; not to place any Order that is fraudulent, speculative or for onward commercial resale without our written consent; and not to use the Website in any way that contravenes applicable law. We may, acting reasonably, suspend or restrict access to the Website, or decline to accept Orders, where we consider such conduct to have occurred.
8. Intellectual Property
